Easements Zoom Study Session
Thursday’s 6pm ET Zoom study session is titled, “Easements” You’ll take the first five minutes of class to answer the question alone, but if you would like to get a head-start on that, here is the assignment:
The municipal utility company recently ran a minor sewer line underground below a series of residential properties. One of the properties placed a prefabricated shed on top of the easement, and the utility company has concerns that the shed is obstructing essential access to a sewer shut-off valve below it.
Which of the following statements is true? Select the three best answers.
If the easement is longer than 100 “chains,” a covenant will be required
If the shed were moved voluntarily by the owner and damaged as part of its relocation, the utility company would be compelled to pay for those damages
The easement access will be enforced by the local municipal zoning laws
The owner must maintain the portion of the property with the easement
The utility company may come, without asking permission, and maintain the sewer buried below the easement strip
The utility company may compel the owner to move the shed
Please don’t post your answer on this thread
