Contracts Question
I've read B101 and A101 contracts, and have a couple of questions about it. and would like to get your thoughts if I'm following the same thinking of everyone.
- Permitting. - Arch scope is only to reach out to the gov't authorities & utility entities to gather if there's any design requirements, and will need to be implemented on the plans. The owner will do the permitting, but the contractor will pay for the permits per A101 3.7. I also do not see permitting listed as supplemental service per Article 4.is it under 4.1.1.30 other supplemental services?
- Inspections - B101 5.9 - says that the owner will furnish test and inspections, A101 3.7 says that the Contractor will secure and pay for building permit and inspections by government agencies. On my work experience, special inspections are done by a third party hired by the owner, the report are always needed by the Inspector from the city for them to provide their approval.
- What will happen if the owner fired his contractor halfway through then hire a new contractor, then the previous contractor portion of the work failed. Is the old contractor still on the hook?
