Nonconforming work

    In a nutshell, yes.  We can reject it.  The owner has the right to override us, however, and accept it as is.  In the event that the owner should decide to override us like this, there is an indemnification clause in the AIA contract that basically says that the owner will be liable for such nonconforming work should something happen in the future.

    Yes, however If it is a code violation, the owner cannot override the architect and accept the work.
