    On an exam I think the answer is yes. The owner is responsible for costs related to building permitting, and the architect did nothing wrong.

    In real life, I'm not sure how this can ever happen, since code cycles are long, overlap, and should be very well known by the architect. Maybe this would happen if the owner paused the project for years allowing the lapse, in which case there's even more reason to absolve the architect.

    Per B101, the architect would receive compensation as Additional Services:

    I would agree that it's best practice to confirm any upcoming/potential code changes with the AHJ, and to line up submissions either well before or wait until after code change implementations occur so an issue like this is avoided.
