Application for payments/ Approved Submittals
During Construction, If the contractor completes a portion of work before approval of shop drawings for that work and submits an application for payment, Is the Architect required to partially withhold payment for that portion of work until submittal is approved? The question is assuming that the completed portion of work was required to be submitted through shop drawings and reviewed and approved. My understanding is that if the Work conforms to the Contract drawings then the Architect must approve that portion of work submitted with the Application for payment by Contractor. AHPP states that the contractor is prohibited from performing those (submittals deemed necessary by Architect) portions of the work without approved submittals, so I'm unclear how the Architect should handle the situation if the work is already done.

It would be unwise to pay a contractor for work that was not approved. The cost of the work in question should not be included in the payment. Likewise, any change orders that haven't been approved shouldn't be built and definitely not paid for.
