Owner's Decision
When building official already approved everything and architect realized a damper or an opening doesn't comply with code, and tells the owner that we have to change the damper, and the owner says no. Architect explains, this is the code, meaning it's law, we have to follow, but owner will not change it, and will not approve the required additional expense despite all written warnings and explanations. What are we to do here as architects, report him? Stop working with him? list the damper as non-conforming work? or just continue working which would be accepting the responsibility, but other options feel a bit like sabotaging yourself.

Hi. Most likely the official for the municipality would notice upon inspection, note it, and it'd have to be changed to something that complies with code. You could call the AHJ and inquire about the damper too, without mentioning the owner's position.
